Aldi in hot water again?

Aldi have recently launched a product-scoopable frozen cheesecake that you can eat straight from the tub. The issue is that there are already 2 companies that do this. Pleese, who are the originators, and English Cheesecake Company whose product came out after Pleese.

Aldi do this regulary (Norpak and Cuthbert the Caterpilla anyone?) but seem to just get away with it with subtle changes. Of course Pleese are not happy, they could try to sue Aldi-like M&S did-but being a small company this could turn out to be expensive.
